Real talk: "I'll formalize once malaki na kita ko" is no longer a safe plan. Bagong batas na yan noon, pero as of 2026, hindi na. Let's break down what you actually need — walang legal jargon, walang paligid-ligid.

Wait, kailangan ko na ba talaga mag-register?

Short answer: yes, the moment your live selling becomes a "regular business activity with a profit motive" — meaning hindi one-time garage sale, kundi actual paulit-ulit na kita. May kaso pa nga last March 2026 — nag-shut down ang BIR ng isang Facebook Live seller sa Cebu over ₱211M sa undeclared sales, ₱40.4M ang tax liability nila. Hindi biro.

And since RMC 55-2025, doing business without BIR registration is now a criminal offense — ₱5,000 to ₱20,000 fine plus 6 months to 2 years imprisonment. So yes, kahit "sideline" pa lang, kailangan mo na mag-move.

Step 1: DTI Business Name Registration

Kung solo ka (sole proprietor), dito ka mag-start. Online pa, sa bnrs.dti.gov.ph:

  1. Create account

  2. "New Application"

  3. Real-time name check (kaya iprepare mo yung backup names, common ang taken)

  4. Pumili ng territorial scope (see fees below)

  5. Upload valid ID

  6. Bayad online

Approval usually 1 working day, pero bayaran mo within 7 calendar days or mawawalan ng bisa yung application.

Fees (plus ₱30 documentary stamp tax):

Scope Fee + DST
Barangay ₱230
City/Municipality ₱530
Regional ₱1,030
National ₱2,030

Most online sellers go with City/Municipality — hindi naman siya nakaka-limit kung saan ka pwede magbenta, name protection lang siya. Valid for 5 years.

Step 2: BIR Registration (yung actual permission mo magbenta legally)

Live sellers register as Self-Employed Individuals. Yes, "Online Seller" and "Content Creator" ay explicitly nakalista na sa BIR classifications ngayon.

The steps:

  1. File BIR Form 1901 (sa RDO or online via ORUS)

  2. Bring valid ID (plus DTI cert mo kung may trade name ka)

  3. Makukuha mo yung Form 2303 (Certificate of Registration / COR) — i-upload mo agad ito sa Shopee/TikTok seller profile mo

  4. Apply for Authority to Print (Form 1906) or bumili ng BIR-printed invoices

  5. Register your Books of Accounts (Form 1905)

Heads up: yung dating ₱500 annual registration fee — wala na yun. Na-abolish under the EOPT Act noong January 2024. Kung may guide ka pang nakikita na nagsasabing may bayad pa, outdated na yun.

Step 3: Yung 8% Flat Tax — dito talaga makikita mo yung savings

Instead of graduated income tax + 3% percentage tax, pwede kang mag-elect ng flat 8% na tax sa gross sales mo lampas ₱250,000.

Qualified ka kung:

  • Gross sales mo ≤ ₱3,000,000 annually

  • Hindi ka VAT-registered

  • Wala kang ibang percentage tax obligations

  • Ni-elect mo siya sa Form 1901 (bagong seller) o Form 1905 (existing)

Filing: quarterly (Form 1701Q) + annual (Form 1701A). Take note: kahit below ₱250k ka pa (tax-exempt technically), kailangan mo pa rin mag-file. "Exempt" ≠ "wala nang gagawin."

Once lumagpas ka ng ₱3M gross sales in a year, automatic ka nang VAT-registered (12%). Pero for most starting live sellers, malayo pa yan — 8% flat ang gagamitin niyo.

Yung bago at malaking bagay: BIR badge, mandatory na sa profile mo

As of RMC 038-2026 (issued April 2026), lahat ng online sellers — kasama live streamers, content creators, at affiliates — kailangan mag-display ng BIR registration seal / eCOR with QR code sa seller profile niyo. Kung wala pang badge, i-priority mo na ito — this is enforcement now, hindi lang suggestion.

Don't skip: LGU Permits

Home-based ka lang? Hindi ka pa rin exempt sa Barangay Clearance at Mayor's Permit — renewed annually every January.

Rough estimate:

  • Barangay Clearance: ₱300–1,000

  • Mayor's Permit: ₱2,000–5,000

  • BIR invoice printing: ₱2,500–5,000

Totoo lang
